District Court Declares Four MPS Companies Bankrupt; Trustee Appointed and Cooling-Off Period Imposed

Following the court order of 28 October 2025, the appointed trustee has assumed responsibility for safeguarding the estates of MPS Holding B.V., MPS Systems B.V., MPS Service & Commissioning B.V., and MPS Supply Chain B.V. The trustee is assessing the financial position and evaluating scenarios for a going-concern sale aimed at protecting customers through continuity of technology and spare parts. During a two-month cooling-off period, enforcement actions are stayed and all operational activities, including production, deliveries, and services, are temporarily suspended while the feasibility of selective continuations or transfers is reviewed.

To guide stakeholders, an extensive FAQ clarifies orders, payments, service, and contracts during the insolvency. Existing orders are suspended unless explicitly confirmed by the trustee; deposits paid before bankruptcy are unsecured claims; and warranty obligations are no longer enforceable against the estate. Customers may still submit service or spare parts requests through regular channels for trustee review; the remote support team and MPS Connect remain operational, and invoices due must be paid to the bank accounts specified on the invoice, with a new account in effect for invoices dated from 23 October 2025; claims, set-off requests, and supplier retention-of-title issues must be filed with supporting documentation to the trustee at curator@stellicher.nl. 

Suppliers are advised that payments are suspended and claims should be filed as unsecured unless security rights exist; open purchase orders are suspended, and any new procurement would likely be cash-on-delivery. Sales agents may submit commission claims, continue using brand materials until further notice, and route quotations and customer inquiries through their MPS sales contacts, while refraining from making independent statements and referring to official communications. General updates will be posted in the Dutch Insolvency Register. The trustee is in discussions with several interested parties regarding a possible going-concern sale, with initial timing guidance of about 1 month.
