LEGAL ALERT: Understanding California SB 1096: New Marketing Mail Requirements

On June 14, 2024 the California’s Gov Newsome approved SB 1096. Subject to certain exceptions, the amendment will require inclusion of a disclosure statement in enlarged, bold type on the front of any envelope containing a solicitation for a consumer financial product or service that would be sent by physical mail. The bolded disclosure must state clearly that the content is an advertisement and that the recipient is “not required to make any payment or take any other action in response to this offer.” The stated motivation behind the enactment of SB 1096 is consumer protection. The law took effect on January 1, 2025 and seeks to address consumer concerns regarding privacy by imposing stricter regulations on the content and delivery of marketing materials. Its impact on advertisers who send marketing mail is potentially significant.
